| Abstract: | Das in 5-er Besetzung ergangene Urteil des Bundesgerichts 4A_714/2016 vom 29. August 2017 gibt eine beinahe lehrbuchartige Übersicht über die bisherige Bonusrechtsprechung und entwickelt die Rechtsprechung zur Abgrenzung zwischen Lohn und Gratifikation weiter. Gemäss Wolfgang Portmann und Roger Rudolph hat das Bundesgericht mit diesem wegleitenden Entscheid seine Rechtsprechung, wonach der Bonus zum Lohn nebensächlich (akzessorisch) sein muss, nochmals massgeblich abgeschwächt. Es rechtfertigt sich daher, die in diesem Urteil enthaltenen Grundsätze überblickartig darzustellen. |
